How the Visa is Issued ?

Foreigners who wish to conduct business or undertake investment activities in Thailand must apply for a Non-Immigrant Visa at the Royal Thai Embassies or Royal Thai Consulates-General.  Various categories of the Non-Immigrant Visa are currently provided to meet the needs and qualifications of individual business persons. 

  1. Non-Immigrant Visa Category “B”  (Business Visa) for foreigners who wish to conduct business in Thailand must provide the following documents:

    • A copy of the house registration of all shareholders

    • A copy of the ID card of the director

    • A copy of the house registration of the company’s office

    • All shareholders’ E-mail

    • All shareholders’ phone number

    • Shareholder’s Equity (foreign shareholder cannot own more than 49% of equity)

    • Regarding the first company registration, foreign shareholders must have a Letter of Certification from the bank to certify the fund in Thailand.

    • Registration of the company with all Thai people’s names is recommended because a Letter of Certification from the bank is not required again.  Then, you can change to the foreigner‘s name after 15 days. 

    • The company’s objectives

    • The company seal

    • A copy of the ID card/passport (foreigner) of every shareholder

    • Prepare the company name in THAI and ENGLISH names at least three to make a reservation for setting the company name.

  2. Non-Immigrant Visa Category "B" (Business Visa) for foreigners who would like to stay in Thailand for business purpose

    • Copy of passport​

    • A copy of the organization evidence, such as a certified company registration or partnership registration not exceeding 6 months from the registrar

    • A copy of the shareholder list certified by the registrar not exceeding 6 months

    • A copy of the balance sheet and profit and loss statement for the latest fiscal year, accompanied by the corporate income tax return (Form P.N.D.50), as well as receipts and copies of Form Sor Bor Chor 3 (must be certified as accurate by the Revenue Department, Ministry of Commerce, or a certified accountant, or provide original documents for the last 2 years)

    • A copy of the submitted withholding tax statement at the payment location, with the names of both Thai and foreign employees who applied last month, along with the receipts

    • A copy of the submitted personal income tax statement of the foreign individual who applied last year, along with the receipt

    • A copy of the lastest three-month Social Security Fund contribution form (S.P.S 1-10) submitted to the Social Security Office, along with the receipt

    • A copy of the value-added tax (VAT) payment statement (Form Phor.Por.30 or Phor.Por.36) for the last financial year's final three months, along with the receipt.

    • Documents or evidence showing the necessity for hiring foreign workers, such as announcements for job openings to Thai nationals without applicants, etc.

    • Map showing the applicant's workplace location

    • Documents or other evidence as specified by the the Immigration Officer's monitoring committee for inspecting the entry of foreign nationals (Form TM. 2)

    • Photographs of the business premises

      • Externally, the establishment's address and signage should be visible.​

      • Internally, photos showing emplyees at work.

    • In case family members accompany, provide evidence of the family, such as marriage certificates, and birth certificates (if issued by a foreign government, they must be authenticated by the respective country’s embassy or consulate)

    • Foreigner’s registered capital of 2 million baht for one person

    • Four Thai employees per one foreign employee

    • Thai nationals must hold more shares than foreigners and contribute 100%

      • Note: Documents may have been altered or modified based on each company’s requirements.

  3. Non-Immigrant Visa Category “B” (Teaching) for Foreigners who intend to take up employment as school teachers at the levels below university level in Thailand must submit the following required documents:

    • 6 self-portrait pictures (2 inches size: 4X6 c.m.)​

    • 6 self-portrait pictures (1.5 inches size)

    • A signed copy of passport (every page)

    • Degree certificate from the university

    • Education transcript from the university

    • Criminal record

    • Personal information

    • Resume

    • Medical certificate

    • TM. 30

      • In case of having a follower

        • 2 self-portrait pictures in 2 inches size​

        • A copy of follower's passport (every page)

        • A copy of family certificate

        • In case of couple, use Marriage certification

        • In case of having children, use Birth certificate

        • TM. 30

        • Criminal record (in case of risk-country)

 

Additional Information :

  • Upon entry into the Kingdom, applicant or his or her appointed representatives must apply for a work permit at the Office of Foreign Workers Administration, Department of Employment, Ministry of Labor in which the applicant will be obligated to pay income tax accordingly.  If the applicant’s associated company is located in the provinces, the applicant must apply at the Employment Office of that province.

  • Applicant’s family members (i.e., spouse, parents and children who are
    unmarried and under 20 years old) are eligible to apply for a Non-Immigrant Visa (category “O”) and will be allowed to stay for a period of 90 days but no longer than 1 year.

  • Foreign citizens who hold a Transit Visa (“TS”) or Tourist Visa
    (“TR”) and wish to engage in business activities in Thailand may apply for a change of type of visa (e.g., from Tourist Visa to Non-Immigrant Visa) at the Office of the Immigration Bureau Office located in Bangkok. The granting of a change of type of visa and extension of stay is at the discretion of the immigration officer.

     

** The application must be submit more than 30 days before visa expiration and, in case of overstaying in Thailand, application could not be submitted."
